The Scottish players' union has issued a strongly worded response to Rangers' claim that 67 unnamed players were raising legal action against both the old and newco.

PFA Scotland initially declined to comment but released a statement on Tuesday saying it wished to clarify its position.

The players' union said that it was entitled to make a claim without the consent of individual members.

The statement said: "For the avoidance of doubt, the claim for a Protective Award has been raised in the name of PFA Scotland only. It is one legal claim and has not been lodged in the name of any player let alone some 67 individual players as has been reported.
PFA Scotland said that the action was also a response to Rangers' decision to ask for Scottish FA arbitration over their right to the contract of departed players, which would see Rangers entitled to transfer fees if decided in their favour.

The union said that it had informed Rangers that the employment tribunal claim would be abandoned if Rangers dropped their claim for arbitration.

Rangers are expected to issue a statement on Tuesday afternoon clarifying their own position .

Looks like this whole thing is another Charles green faux pas chasing long gone players for their new signing on fees. If he wasn't so deliberately misrepresentative these problems wouldn't be popping up.

 


How can we move forward when this legacy stuff is going on? I don't believe for a second we legally have any shout over these guys. Let them go and drop all these legal cases. Only the lawyers make.

also the incident at man city game at the weekend was shocking and the talk is that they are looking at having netting around pitches to stop things being thrown at players i dont think this is the answer what is the answer is for these mindless persons to be found and stopped from attending games. we need more self policing at games that brilliant game at the weekend was spoiled by the crowd trouble.

and quickly your views on diving over the years we have seen diving involving our players and players from the dafties from the east end. its about time divers were hit hard both with suspensions and heavy fines this will deter them from doing it again we need to stamp this out as it is ruining football and making referees games harder than it already is. {Ed001's Note - what is worrying is what kind of mess is Italian footie in that only bloke bothered to travel? Fair play to him though, I agree, he defo deserves to get special treatment. If it was up to me, I would have brought him into the dressing room after the match and made every player in the squad, and all the other staff, sign a kit for him and, if possible, taken him back with the squad in first class.
I agree with you completely, netting etc are not going to stop there being issues, it is up to the fans to stop it. The stewards and police need to work with the fans better, to identify and remove troublemakers, as well as stopping them getting in to begin with.
I hate diving, I hate the attitude displayed by commentators too, they fail to condemn it and talk about 'clever play'. They should be calling it what it is: cheating. Tougher punishments also need to be brought in, bans would soon bring in to a halt.
Oh and one other thing, I really wish they would stop having the game stopped while someone is treated and then make them go off afterwards. It is nonsense. Get them off the pitch for treatment, then no one is going to get treatment unless they actually are injured.}


PFA Scotland now proving it's self as incompetent as the governing bodies in this country. Clubs are almost at civil war, income down you would think that Wishart and Co would concentrate on players who actually need/want there assistance. As for Lafferty, nothing more than clown earning vast sums of money. He should have been dismissed by Rangers a couple of games into his contract!! A complete and utter waste of money


Strange how its SFA, SPL, PFA, D&P, BDO, HMRC, .... All getting it wrong and incompetent. When the reality is they are all competent and doing their jobs (including going easy on oldco and newco). It's Rangers and Rangers alone to blame for all their troubles. Owners, Directors, managers, players and yes fans as well.

Charles Green Statement
WRITTEN BY RANGERS FOOTBALL CLUB

CHARLES GREEN, Chief Executive of Rangers, issued the following statement today:

In view of the extensive and somewhat sensationalised media coverage of actions allegedly being taken against the Club by players past and present, I would like to clarify the position for our fans.
"There are three separate disputes or litigations ongoing. The first is the Club's action for damages which has been lodged with an SFA Arbitration Tribunal.
"A number of players, Alan McGregor, Kyle Lafferty, Rhys McCabe, Sone Aluko, Steven Davis, John Fleck, Steven Naismith, Steven Whittaker and Jamie Ness objected to their contracts of employment being transferred under TUPE regulations from the oldco Rangers to the company as it now stands.
"The transfer was carried out as with every other member of staff in order to protect employees during oldco Rangers insolvency.
The Rangers Football Club believes the players' objections were incompetent and the players unilaterally terminated their contracts in an unlawful manner and is pursuing damages through the SFA Arbitration Tribunal.
Discussions took place with representatives of some of the players and agreements were reached with Davis, Fleck and McCabe.
Representatives of the remaining players have challenged the right of the Club to be involved in the SFA process and a preliminary hearing has been fixed for January 7, 2013 to determine these jurisdictional issues.
"Senior counsel has advised the Club that prospects of winning these preliminary arguments are good. If the Club is unable to pursue its rights through the SFA there are other routes available to pursue compensation from the players and their new clubs.
Separately PFA Scotland has raised an employment tribunal claim against the Club supposedly on behalf of 67 unnamed players, alleging a failure to consult on the part of oldco prior to the players' contracts being transferred on June 14.
"Senior counsel has given a robust opinion that PFA Scotland has no locus or standing to raise such a claim in the circumstances of the case.
The fact that many of the supposed 67 players are still at Ibrox and have indicated they have no part in this action begs the question why it is being raised at all.
"Further, it appears that a number of players whose contracts were due to terminate at the end of last season and who were never in line to transfer under TUPE have been included in the numbers.
"Also, a number of former players have already signed agreements with the Club waiving any right to participate in this claim.
In reality, we are talking about six players who have some form of dispute rather than 67.
"Rangers fans will note how the Club captain Lee McCulloch and a number of other players have quickly dissociated themselves from this action.
"I have also had the father of one player calling, quite furious that his young son has been attached to an action he knew nothing about.
"PFA Scotland has confirmed as much in its statement earlier today. That statement confirms that the failure to consult claim apparently lodged for the benefit of 67 players will be withdrawn if the Club's SFA damages claim against the 6 players is dropped.
"The purpose of the failure to consult claim is therefore not to safeguard the rights of the 67 players but to attempt to persuade the Club to abandon its legitimate pursuit of compensation from players who in the Club's view, walked out on their contracts of employment.
Finally three players - Aluko, Lafferty and Ness - have also raised constructive dismissal claims against the Club as it stands now.
"We have challenged their right to do so and these are low value claims. It should be noted that the players were employed by new clubs almost immediately on terms we believe to be at least as beneficial as those they enjoyed at Rangers.
It is disappointing that players who have left the Club to further their own careers rather than play in Division Three should be continuing with these actions or allowing them to be progressed on their behalf.
"I am in no doubt that the supporters who are showing such outstanding loyalty to Rangers will form their own views as the Club continues to rebuild.

Wow - green finally has to come clean, legal opinion good and robust, not very strong then.

Good news is now there is SHARE floatation in place, and FSA (and go-to-jail threats) info is flowing

this can only help fans.

One question - if low value claims, why not settle out of court ? Why do thru bother of legal cases, where you must pay legal costs.... and could loose.


CG is playing with fire. Counter-claims could cost the club money it could do better spending (or saving for) the transfer market.

The players had the right to leave (or rather, not transfer) - of that there is no doubt. Whether Rangers get any compensation from the clubs they signed for depends on various football rules. The lawyers at Norwich etc will have done their homework too.

So Green thinks he has jurisdiction in this process relating to oldco but believes the opposite in the dual contracts process. The guy screams jurisdiction or not jurisdiction to suit his particular point of view - make your mind up mate.....


Just like hmrc this is a no lose case for the club hope the person six have been saving their pennies

Is that the same players who took massive paycuts to keep Oldco going until the end of the season. The same players that had no idea if they would have a club to play for never mind having wages.

CG should drop all this legal stuff and let these players get on with furthering their own careers and he should concentrate on trying to rebuild to be truthful and honest about the state of The Rangers International Football Club PLC or whatever it is called now.

I don't see this issue as the PFA or RFC being incompetent or wrong....

The real problem IMHO, is with the media handling of the incident - Front page news no less!!

The PFA have stated clearly that it is not in connection with individual players, and has absolutely nothing to do with individual players, yet the media clearly want to indicate that this was the case. Charles Green stated on Scotland Tonight, that at the time of the CVA there were only 51 (I think) players on the books....

The whole thing has been blown out of all proportion by the Scottish media in an attempt to get another kick @ RFC


Charles Greens body language look tired and fed up with the whole Rangers saga!...Im thinking he wishes he never ever bothered now!


6 people will have "no-win, no-fee" cases, rangers will have to pay thier legal fees, even if they win.

TUPE is all in employee favour, one mistake by newco and employee could walk away for nowt as they always had this right.


This situation is going to rumble on for years, TUPE regulations are clear, and under normal circumstance the players would have been able to walk away from their contracts. but when it comes to footballers these are not normal circumstances, as well as being employee's players are company assets, having in some cases cost millions of pounds.
