I was speaking to my brother yesterday regarding the EBT saga and he made a good comparison. He said:

"It's like reducing the speed limit on a stretch of road and then trying to punish every driver who previously observed the old speed limit. "

He's totally right too. No criminality was involved. Rangers were simply using a loophole that existed at the time.

the government introduced the EBT as a legal way of reducing the tax you pay kinda similar to an ISA

then it realised oh wait too many people are benefitting from it so let's do a u-turn

right if you used our EBT scheme you were illegally dodging tax so we want all the tax bank

and we end up getting liquidated and now they want our titles stripped

To be completely honest guys. That's not the case. EBT's are and remain legal but it was the operation of the scheme by Rangers during the time which was incorrect.

I'm 2004 HMRC asked Rangers if there were any side letters and we said no. The Boumsong raid in 2008 found these letters which showed the payments were actually earnings which is why the Supreme Court ruled in favour of HMRC.

That being said, I don't buy into the whole competitive advantage argument as who is to say we wouldn't have just paid the additional amounts if we didn't operate the scheme?

There was no loophole. EBT were supposed to be loans. In SDMs case the loans were never meant to be repaid, so outwith the rules of EBTs.
If the there was no criminality and everything was above board why was SDM not upfront about the use of EBTs to the football authorities. Instead he buried them from sight.

My understanding is that EBT's were included in accounts submitted to SPL each year and side-letters only referred to repayment of these. If so, what are the undeclared contracts?
Therefore if I am correct, what SPL or SFA rule are we accused of breaking?

Seriously?! Perhaps Celtic have a gripe, and even that is pretty tenuous given they also used tax avoidance schemes, but the rest of Scottish football need to wind their necks in!

Were Aberdeen or Dundee Utd going to challenge for titles if we didn't use EBTs? Of course not. Did they and the rest of Scottish football enjoy a higher standard of football and a reputation boost off the back of EBTs? Of course they did.

All the wee diddy teams should be thankful we dragged the standard of football on show away from the pub leagues for a bit and leave the conspiracies to Celtic.

Was just about to post the same. Dundee united were closer to relegation than top during these years. Did they complain about how many fans we brought up with us then. The longer they rot in the championship the better

The problem is if one club starts it the rest will follow suit, the higher up the league you finish the more money you get. DU will think they would have had a better chance of beating us if we never had Klos etc. End of the day it was 11 men v 11 men, every club is guilty of trying to cut corners and dodge tax in someway or another.

End of the day this is a business matter not a footballing matter.

As others have already posted the use of Etb's were not illegal so the argument from certain others is that it was the failure to disclose the detail to the SPL that is being pushed as the excuse to punish us, the SAME failure to disclose that is well documented by Celtic who themselves failed to inform the SPL of details of their use of etb's.
There seems to be a lot of comment here from people who are agenda driven but don't do their homework in regards to who did what and why, did the Celtic player who was payed with an etb after he had left the club pay it back? . Look it up for the answer then come back with a reply, after all rules are rules ☺

I reckon £700'000 max for him he's in the last year of his contract maybe if he had 2 years left on his contract £1 million would be about right for the guy but hearts in my opinion are just holding out for as much as they can get for their player which they are entitled to do but either way it's a tough 1 for hearts as a club and the player himself because of the last year contract situation after all it's the same situation as our own Barry McKay is in as well
